oilfields in Irag. and was monopolistic. Technically a
clause in ohe mandate against the grant of any mononolistic
concession tfould have been held not to affect the valida
tion by the Iraq Government of a legitimate pre-war

terms of the treaty with Turkey. However, it would probably
have created a bad effect to have accepted the no-monopoly
clause in the mandate and then to have let the oilfields
be monopolised by the Turkish^ Company.
In these circumstances it Y/as decided not to
ask the Council of the League to define the terms of
the draft mandate for Iraq, but to continue to proceed on
the basis, publicly adopted in our notes with the United
States Government that the Turkish Petroleum Company
had a valid pre-war concession in Iraq which His Majesty's
Goverrment v/ere bound to uphold.
At the same time it was thought that it should
be possible to persuade the United States Government to
withdraw their opposition (a) to the draft Iraq mandate in
its published form (i.e. without the no-monopoly clause)
and (b) to the Turkish Petroleum' Company 1 s concession if
American oil interests were brought into the Company. Hx

On the outbreak of the Y/ar, the shares of the
Turkish Petroleum Company were roughly, 50 per cent Anglo-
Persian Company; 25 per cent Deutsche Bank; and 25$
Anglo-Saxon (a branch of the Royal Dutch Shell). The
