now under Turkish rule, the exploitation of these oil
deposits would long since have hegun* It can hardly be
contended that His Majesty*s Government should now question
the validity of an undertaking granted by the Turkish
Government in return for consideration received* w
This correspondence with the United States
Government concluded with a note from Mr. Harvey of
Movember 17th, 1921, not yet published, in which the
United States Government continued to contest the
validity of the Company's claim, asserted that it was in
any case monopolistic in character, which was inconsistent
with the proper method of "dealing with the resources of
mandated territories, placed under conditions of trusteeship"
and asked that "the claim of the Company,if it continues
to be asserted, should be determined by a suitable arbitra
tion. "
About the same time in separate correspondence
relating to the terms of the draft mandates, the United
States Government asked that a suitable clause should be
inserted in the draft mandate for Iraq excluding the grant
of monopolies*
The whole position was considered by His Majesty's
Government. Before the war, according to the Grand
Vizier's own letter of June 28th, 1914, the rights in
these oilfields were in the hands of the Ministry of Finance*
Therefore if the Turkish Petroleum Company's claim were
considered invalid by the Ira^ Government, the pre-war
rights of the Turkish Government in the oilfields would
pass to the Iraq Government who would be free to develop them
