incident should have taken place at this juncture#
It will be remembered that consequent on the
application of the Eastern & General Syndicate for an
oil concession, the question of obtaining from the
Sheikh of Koweit a formal written request that His
Majesty the King should exercise gurisdiction on his
behalf in respect of all foreigners in his territory
is under active consideration, and that we had rather
hoped by action on these lines^whichwould in practice
effectively safeguard foreign interests to avoid the
possible difficulty which might arise out of the
exercise of jurisdiction over foreigners by the Sheikh
or a claim by the United States that, Koweit^ having been
in the past a part of the Turkish Empire, they still
possessed capitulatory rights in it * since those
rights had not been formally abrogated by any new
arrangement. But as the case of Dr.Reasoner has been
settled satisfactorily so far as the local Americans
are concerned, perhaps no great harm may prove to
have been done, though the incident will have
focussed attention on the existing position regarding
jurisdiction over foreigners, and will make it
unlikely that a future modification of the Koweit Order
in Council which will result in the exercise of
jurisdiction by the P.A. over Americans or other
foreigners will (as we had hoped might be the case)
pass unnoticed.
