Article 6 — (A) The Company shall
maintain in the region oi the Persian Gulf The historical term used to describe the body of water between the Arabian Peninsula and Iran.
a Chief Z-ocal Representative to represent
it in matters relating to this Agreement
with the shaikh. The Shaikh has the
n<rht to select on the first occasion the
chief Local Representative in consultation
with His Majesty’s Government.
(B) The Shaikh shall have the right
to appoint an Arab conversant with the
English language to act as his Official
Representative and who will represent him
in Kuwait in matters relating to this
Agreement with the Company and particu
larly whenever unskilled labour is recruited
from among the subjects of the Shaikh
this Representative shall be consulted and
advise the Company regarding anv such
recruitment. The salary of the Represent
ative shall not be less than Rupees Indian silver coin also widely used in the Persian Gulf. Eight
hundred ( Rs. 800/-) per month, and such
salary shall be paid by the Company
monthly to the Representative as from the
date of his appointment by the Shaikh.
(C) The Shaikh shall have the right
to appoint-from the eftective date of this
Agreement - a Representative in London
to represent the Shaikh in all matters
relating to this Agreement with the Company
in its London Office and such Representa
tive shall have full access to the production
records of the Company including the
agenda of the Board meetings and shall be
entitled to attend the Board’s meetings at
which the Shaikh’s interests are discussed.
The salary of such Representative shall not
be less than Rupees Indian silver coin also widely used in the Persian Gulf. Two thousand two hun
dred and fifty (Rs. 2250) per momh which
shall be paid to the Representative by the
Company and not by the Shaikh, The salary
of such Representative shall be paid either
in London or Bombay as requested by him.
Travelling and general expenses of the
Representative shall be defrayed from the
above mentioned sum of Rupees Indian silver coin also widely used in the Persian Gulf. Two thou
sand two hundred and fifty (Rs 2250)
(D) . If at any time during the currency
of this Agreement any dispute shall arise
reg trding the accuracy of the accounts of the
Company in connection with the amount of
the Royalty and/or other payments due to
the Shaikh under this Agreement, the
Shaikh shall have the right to appoint
in consultation with His Majesty’s Govern
ment - a registered firm of Auditors to
examine the books of the Company, on
behalf of the Shaikh, at Kuwait and/or in
London as he may consider necessary.
All expenditure incurred in connection with
•such auditing shall be paid by the Shaikh.
The Company shall provide the
registered firm of Auditors appointed by
the Shaikh the necessary facilities to
enable them to check the books and
registers of the Company and to render
every assistance to enable the Auditors to
thoroughly examine such accounts and in
every way to assist them safeguard the
interests of the Shaikh.

The file is primarily concerned with the conclusion of the Koweit [Kuwait] Oil Concession negotations between the Shaikh of Kuwait [Shaikh Aḥmad al-Jābir Āl Ṣabāḥ], and the Kuwait Oil Company (KOC). Correspondence includes discussion between both parties and the India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. over final amendments to the wording of the concession agreement, the confirmation of the Shaikh's readiness to sign the agreement, and His Majesty's Government's decision to approve of the decision. The official signing of the concession took place at the Political Agency An office of the East India Company and, later, of the British Raj, headed by an agent. , Kuwait, on 23 December 1934 in the presence of the following: the Shaikh of Kuwait; Frank Holmes and Archibald Chisholm, negotiators for the KOC; Harold Dickson, Political Agent A mid-ranking political representative (equivalent to a Consul) from the diplomatic corps of the Government of India or one of its subordinate provincial governments, in charge of a Political Agency. at Kuwait. Signed copies of the concession, in Arabic and English can be found at folios 21-41 and 211-218.

Further correspondence in relation to the concession includes arrangements to send geologists to Kuwait to undertake surveys, and a discussion around the requirement for the India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. to approve the employment of any non-British individuals by the KOC.

Also included are records of interdepartmental discussions relating to the negotiation process, thoughts on the concession agreements presented by KOC and Traders Ltd, the decision to approve the Shaikh of Kuwait's agreement to sign the KOC concession, and possible courses of action in anticipation of criticism from Lord Lloyd (George Lloyd, 1st Baron Lloyd) over the decision to award the concession to KOC. The individuals involved in these departmental meetings included the following: Gilbert Laithwaite, John Walton and George Crombie from the India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. ; Frederick Starling of the Petroleum Department; George Rendel and Kenneth Johnstone from the Foreign Office; and Ebenezer Seal from the Admiralty.

Also discussed are the negotiations between the Shaikh of Kuwait and Traders Ltd which took place between September and November 1934, along with the rumours and suspicions regarding the financial backing and support for the Company, the possible involvement of members of the Anglo-Persian Oil Company (APOC) in the process, and the conduct of the Shaikh of Kuwait in having entered into negotiations without prior approval from His Majesty's Government and having broken a promise to the KOC not to entertain any other competitor at that time.

Other matters discussed in the file include:

  • The Standard Oil Company of California's option regarding the Saudi Arabian share of the Kuwait-Nejd Neutral Zone Concession and the possibility of it working with the Iraq Petroleum Company in order to obtain the whole concession (folios 56-57, 188-191, and 206-210) .There is also reference to a geological survey of the Neutral Zone undertaken by British representatives
  • The visits of Harry St John Philby and Stephen Hemsley Longrigg to Kuwait in 1935, both of whom were interested in ascertaining the Shaikh of Kuwait's position regarding the Kuwaiti share of the Neutral Zone concession (folios 170-192)
  • The Kuwaiti-Saudi Arabia blockade conference, including correspondence on where the negotiations were to be held, the numbers of delegates permitted by both sides, and the Shaikh of Kuwait's insistence that any settlement must be based on a solution involving the customs post and the manifest system (folios 193-204).

Arrangement

The contents of the file have been arranged chronologically based on the date of their receipt at the India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. .

There is an index located on folio two of the volume; the folio references given in the index relate to the former folation sequence of pencil numbers not enclosed in a circle.

Folios 219-223 contain file notes recording each individual item of correspondence in the file, with folio numbers written in pencil in the margins to refer back to the actual items so that the notes can be used as a further index.

Physical characteristics

Foliation: the foliation sequence (used for referencing) commences at the first folio with 1 and terminates at the last folio with 223; these numbers are written in pencil, are circled, and are located in the top right corner of the recto The front of a sheet of paper or leaf, often abbreviated to 'r'. side of each folio. An additional foliation sequence is present in parallel; these numbers are also written in pencil, but are not circled.
