Dkaft Agreement Concerning 'Iraq Presented by the Sultan of
Nejd on the i 9 th October, 1925.
Article 1.
(a) Each of the contracting- States of Nejd and ‘Iraq admits that
raids committed by tribes residing in its territory across the frontier
of the other State is a crime necessitating the severe chastisement
of its perpetrator by his Government; and the chief of the tribe wh<r
admits this crime will be held responsible.
(b) With a view to establishing the occurrence of a criminal raid,
assessing the amount of plunder and fixing the responsibility, a special
committee shall be set up to enquire into raids; this committee to be
composed of an equal number of representatives of the Governments
of Nejd and ‘Iraq, and its presidency The name given to each of the three divisions of the territory of the East India Company, and later the British Raj, on the Indian subcontinent. shall be entrusted to a person
to be selected from a neutral Government by agreement between the
two Governments. The decisions of this tribunal shall be executorv
(i.e., final).
(c) When sufficient evidence shall have been collected to establish
the occurrence of a raid and the amount of the losses, and shall have
been accepted by the committee referred to in section (b) above, the
Government to whom the defendant tribes are subject will take the
necessary measures for compelling the persons concerned to return
the looted property in accordance with tribal customs, and for punish
ing them as stated in section (a) above.
Article 2 .
Tribes belonging to one of the two Governments may not cross the
frontier into the other State except with a permit from their Govern
ment, endorsed by the other Government.
Article 3.
The two Governments of Nejd and ‘Iraq solemnly undertake that
they will stand in the way, by all the means at their disposal, of the
immigration of tribes or sections of tribes from the one territory into
the other unless it be with the cognisance and approval of the
Government to which they are subject. And they undertake to
abstain from offering presents, of any kind whatsoever, to refugees
from the territory of the other State and to look with disfavour on
any of their subjects who may seek to entice or encourage foreign
tribesmen to come over into their territory.
Article 4.
Neither Government (of ‘Iraq or Nejd) may correspond with the
chiefs or sheikhs of tribes subject to the other Government on official
or political matters.
Article 5.
The forces of neither Nejd nor ‘Iraq will be permitted to cross the
frontier between them in pursuit of offenders except by mutual agree
ment.
Article 6 .
Sheikhs holding an official position or who have flags or standards
showing that they are the leaders of armed forces may not appear
with their flags and standards whenever they desire to cross the
frontier into the territory of another Government.
