I have to thank you for your letter
oi“ the 18th November stating that the
Company accept the proposed Refinery
Agreement in the form finally suggested anc
making certain comments in that
connection. These comments are being
brought to the notice of the interested
departments of His Majesty’s Government.
As regards the Preemption Clause, it
is the case that I told Longrigg we were
considering favourably the suggestion for
taking this out of the individual
Political Agreements and adding it to the
Refinery Agreement, and that I anticipated
this would be agreed to. Since then,
however, we have been going into the
matter further and it seems to us
inevitable that the individual Sheikhs
should assent to the Preemption Clause
(which among other things provides for
H.M.G. taking over the entire working of
the concession in certain circumstances).
This being so, the point of removing the
Clause from the Political Agreements loses
its force (the idea of course is that the
Refinery Agreement should not have to be
"
submitted to the individual Sheikhs), and
we propose to leave it in. No question
principle is I think involved!

The papers include: comments by various British Government departments (including the Admiralty, Air Ministry, Petroleum Department and the Foreign Office); drafts of the agreements; correspondence from Petroleum Concessions Limited (PCL); correspondence concerning the insertion of a pre-emption clause in the political agreement setting out the British Government's right of pre-emption of all crude oil obtained under the concession in the event of a state of national emergency or war; signed copies of the two agreements, dated 5 February 1937 (folios 20-23); and India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. confidential print entitled 'Dubai Oil Concession and Connected Documents', containing copies of the political agreement, the commercial agreement between the Shaikh of Dubai and Petroleum Concessions Limited, dated 22 May 1937, and related correspondence.
