Company got to 500,000 tons per annum of crude oil they
would automatically have to set up a refinery with a
capacity of 250,000 tons, and increase the capacity of the
refinery pari passu with the increase in the production of
crude oil so that it should always be half the crude oil
production. The Company said that an undertaking of this
kind was totally impossible and that it might involve them
in pouring several hundred thousand pounds down the drain,
since there might, when it came to the point, be no market
for their refined products. They argued that it was
essential that commercial considerations should be taken
into account in arriving at a decision in regard to the
erection of a refinery. This view seemed to this
Department entirely reasonable and was accepted by the
Admiralty and the Petroleum Department. As a result a
compromise has been suggested to the Company and it is
understood that they are likely to accept it, or at any
rate something not very substantially different from it.
The compromise is at P.Z. , flag ged _D , and
there are certain passages in it underlined in red which
may not be acceptable to the Company. The Admiralty, who
are the Department really concerned, do not press for
these words if they are not acceptable to the Company.
9. In the circumstances sanction is requested for
the conclusion of the refinery agreement with the Company
either w r ith or without the underlined words as circumstances
may dictate.
10. Finally it is proposed at the time of the
signature of the concession and the political agreement
(the refinery agreement is to be secret between H.M.G. and
the Company and will not be divulged to the Sheikhs
concerned) to exchange notes with the Sheikh of Debai
similar to those exchanged with the Sheikh of Qatar at the
time of the signature of the Qatar concession and agreement.

The papers include: comments by various British Government departments (including the Admiralty, Air Ministry, Petroleum Department and the Foreign Office); drafts of the agreements; correspondence from Petroleum Concessions Limited (PCL); correspondence concerning the insertion of a pre-emption clause in the political agreement setting out the British Government's right of pre-emption of all crude oil obtained under the concession in the event of a state of national emergency or war; signed copies of the two agreements, dated 5 February 1937 (folios 20-23); and India Office The department of the British Government to which the Government of India reported between 1858 and 1947. The successor to the Court of Directors. confidential print entitled 'Dubai Oil Concession and Connected Documents', containing copies of the political agreement, the commercial agreement between the Shaikh of Dubai and Petroleum Concessions Limited, dated 22 May 1937, and related correspondence.
