Government of India are reviewing as are His
Majesty’s Government in regard to the United Kingdom, the
whole field of War Legislation in India with a view to
examining which parts of this legislation could be dispensed
with on the termination of hostilities (a) in Europe, lb)
in the East; and have circularised all Departments for
advice on the following points:-
(i) Is it anticipated that it will be
possible to withdraw or modify any such
acts/ordinances/rules/important orders, etc.
on the termination of hostilities, and if
so which?
(ii> Is it anticipated that any new powers
will have to be taken in the period after
the termination of hostilities?
(iiil What difficulties are anticipated in
f iving effect to proposals under (i) and
ii) above?
2. Rule QIC of the Defence of India Rules
refers to Regulation No. 2 of 1942 made under the Persian
Gulf States ^Emergency) Order-in-Council 1939, and was
issued as a result of Hay’s demi-official letter No. 379-S/
42 dated 16th May 1942. So far as this rule is concerned,
we propose to reply to Defence Department as follows:-
(a) Paint- ,U) 1 "it is
thought that it will be possible to withdraw
the rule, but not until the cessation of
hostilities both in Europe and the East."
(b) Point (liV: - "No 1 :
(c) Point (iii): - "No difficulty is anticipated
• at present."
3. We should be glad to know by telegram whether
you have any comments to make in this connection.
