FORM OF LETTER TO BE WRITTEN TO PRIVATE LITIGANTS IN POSSESSION
OF THE ORIGINAL OR A COPY OF A DOCUMENT FOR WHICH IT IS DESIRED
TO CLAIM PRIVILEGE IN THE PUBLIC INTEREST.
[Memorandum, paragraph 11 (3). The letter given here is that written by the Ministry of
Transport in Ankin's case; see ibid.]
"Sir,
"In reply to your letter of the 5th November on the subject of legal proceedings in
connexion with an accident that occurred at Clapton Station on the 17th November, 1928, I am
directed by the Minister of Transport to state that, in his view, the notices of accidents furnished
to him by the railway companies in pursuance of section 6 of the Regulation of Railways
Act, 1871, are furnished for his own information and guidance in the performance of his duties,
and that their utility in this respect might be prejudiced if they were compiled by railway
companies with the knowledge that any information contained in them might be used by
individual members of the public for the purpose of prosecuting their private claims against the
railway companies concerned. In these circumstances it is the practice of the Minister to
decline, in the public interest, to comply with any request which he may receive for permission
to inspect or to obtain copies of such notices "
