In continuation of our despatch No. 7, dated 10th instant, regarding the
proposed modification of the Commercial Treaty with Persia, and in connection
with the subject of our despatch No. 19 of this date, on the question of
Consular jurisdiction in Persia and the Gulf, we have the honor to forward, for
the information of Her Majesty’s Government, copy
No. 6137, dated 26th October 1871. • n j. i i* T) w
of the letter marginally noted from the Bombay
Government, regarding the claims of British against Bersian subjects at Bushire.
2. These claims, as we had the honor to report in our Secret despatch
No. 8, dated 17th January 1873, have now been finally settled, hut the causes
that led to the delays experienced in settling these long-pending cases still exist,
and the same difficulties are likely to recur in the event of similar cases arising.
3. Colonel Belly strongly urges the establishment of a Tribunal, which he
thinks should he a mixed one, for the adjudication of cases in which British
subjects are plaintiffs and Bersians defendants. It does not appear whether he
thinks this important in the case of the other Bowers. We are of opinion that
the establishment of a Tribunal of the nature proposed would he very desirable
in the case of Bersia, but such an arrangement clearly requires a new Treaty.
4. We would accordingly recommend that the proposal be communicated
to Her Majesty’s Boreign Office for such action as may he deemed necessary,
and if Your Grace concur with us as to the advisability of the proposed measure,
the details necessary for carrying out the arrangement can be supplied after
Colonel Belly and Sir B. Prancis have concluded their conference at Constanti
nople.
