"below and the alternative draft produced by the sheikh
of Qatar.

These are to be a matter for further discussion. I have
noted in the margin the more important differences of
substance (the wording is, of course, substantially
different throughout) between the revise and the Company’s

draft. But broadly speaking I ao not think thatfanything
very vital is involved with the exception of the provision
in Article 12 that not more than one subsidiary or
transferee company shall be formed; the elaboration of the
provisions regarding force maieure in Article 15; the
Sheikh’s proviso that he shall agree to the third
arbitrator in Article 16; and the modifications of
Article 17. There is also a modification of some little
importance in Article 21.
3. The really important modification - the
suggestion that disputes between subjects of the Sheikh
and foreign employees of the Company should be dealt with
by the Shara Courts - is in Article 18. The company not
unnaturally object to this and we should, I think, support
them on it. Our difficulty, of course, is that there is
no Order-in-Council, so that any arrangement in regard to
jurisdiction will be a matter for discussion with the
Sheikh, on this we may have to consult the Resident. But
whoever obtained the Qatar concession we should have to
make a similar provision and if necessary this could be
made clear to the sheikh.
