ability and he is already on excellent terms with the Company’s local represen
tatives. If and when his appointment materialises it will probably be neces-
• sary to pay him frona Tomans 100 to 150 per month, and the subsidy of the
Company to Haidar Khan during the preliminary operations will, for practical
purposes, be given m this form.
Translation.
An agreement entered into between Messrs Anglo-Persian Oil Company
Limited on the one part and hereinafter called “ Tne Company ” and Sarkar
Haidar Khan, C.I. h., Zabit of Haiyat Land and i£har ig, on behalf of himself
and his brother Muhammad Khan his heirs and successors and on behalf of all
his tribesmen, hereinafier called “ The Zabit,” in respect of the privileges and
lands required, by the said Company in the territories of the former, for the
purposes of their business under the exclusive rights of the concession granted
to Mr. W. K L’Arcy by the Imperial Government of Persia in the month of
Safar 1319 equivalent to the month of May 1901.
Article 1 .—The Company shall have the right to search for obtain and use
water and to construct tramways, roads, paths, houses, sheds, bricks and
reservoirs whether for their staff or for their work, to erect tanks, pumping
stations, telegraph and telephone lines and all kinds of machinery to lay pipe
lines and to carry out such construction work as they may deem necessary
in any part of the said territory.
Article 2 .—All lands required by the Company for the purpose of their
preliminary exploration for oil whether arable or non-arable in the territories
of Hayat Laud together with an adequate supply of water so far as it is avail
able shall be granted by the said Zabit to the Company free of
charge, and without let of hindrance from any of his relatives, dependents
or any of his tribesmen. And it is hereby agreed that, in consideration of the
sums paid to the Zabit laid down in Article 3 any claim for compensation put
forward by a third party in respect of such land shall be met by the said Zabit
or his heirs and successors and that under no circumstances shall the Company
be held liable to pay compensation for the same. The Company shall give
the Zabit due notice of the areas of land which they may need to take up in
any part of the said territory in connection with the oil works and the Zabit
undertakes to hand over the same to the Company for the exclusive use of
their works.
Article 3 .—-As soon as the Company has been successful in finding oil in
sufficient quantity to justify the laying of a pipe-line and as soon as the
said pipe-line has been completed and the oil is being exported thereby,
the Company hereby undertake to rent or purchase at their option and the
Zabit hereby undertakes to rent at the option of the Company whatever land
may be required by the Company for their operation at the following rate :
For every jarib of 1,000 square Zarhs, ten tomans per jarib for arable
land and five tomans per jarib for non-arable land whether owned privately or
belonging to the tribes or to sell at the rate of 100 tomans and 50 tomans per
jarib respectively.
All lands acquired by the Company as above shall be the absolute
property of the Company for the period of their concession or any ex ension
or renewal therefrom and the Company shall have full proprietary rights over
these lands. At the expiry of the concession or any extension ^ereef, all
immovable property left in situ by the Company shall be handed to the Zabit
or his heirs and successors in trust for the Persian Governmen , o w om s
